The Osage Nation of Indians is a federally recognized Indian Tribe organized under the Act of June 28, 1906, 34 Stat. 539 ("1906"), and the Osage Tribal Council (the "Council") has a full govermental power and authority to act for the Tribe pursant to the 1906 Act; and
It is declared the policy of the Tribe to promote the continued development of the Osage Reservation ( as defined in OTGE Charter) economy; to seek greater self-sufficiency through economic development, and to create employment opportunities for its tribal members; and
The Council has the power and authority pursuant to the 1906 Act to adopt and approve plans of operations to govern the conduct of any enterprise, business or industry that will further the economic well-being of the Tribe, and to undertake any activities not inconsistent with the laws of the United States of America designed for the social or economic improvement of the Tribe and its members; and
The Gaming (as defined in the OTGE Charter) industry and related opporunties are important to the economy of the Tirbe and the genereal welfare of its members; and
The ability of the Tribe to finance , develop, construct, operate and maintain certain Tribe Gaming Facilities (as defined in the OTGE Charter) and Related Gaming Facilities (as defined in the OTGE Charter) will be enhanced by the formation of an unincorporated business enterprise wholly-owned by the Tribe for such purposes, and the unincorporated business of the Tirbe created by the Charter will be able to perform these functions, and accordingly, will be of benefit to the Tribe and its members.
On March 11, 2006 the CONSTITUTION OF THE OSAGE NATION was ratified with the Signatory date May 6, 2006. Which resulted that there shall be established, by Osage Law, a Tribal Enterprise Board in the Executive Branch, and the Principal Chief shall appoint qualified professionals to oversee operation of the Osage Nation business enterprises, by and with the advice and consent of the Osage Nation Congress. The Osage Nation Congress shall reserve the right to review any action taken by the Board, and may approve the Annual Plan of Operations for the coming year. No Osage Nation elected official may be appointed to such Board.
